Scalia: Get over it!



I know this isn't exactly from 2000, but Scalia definitely has his own primary source opinions on the issue. He gets very defensive, and "get over it!" is a way of dodging a question. There is no doubt that his conservative bent certainly was a factor in his actions during the recount. I found this video fascinating because it shows a Supreme Court Justice getting flustered and embarrassed because he failed to make an objective decision in 2000.

There are two major problems with Scalia's remarks here:

1. The U.S. has a system of common law in which ever legal decision sets a precedent. In light of that fact, he should be able to explain and defend the legal precedent established by Bush v. Gore. "Get over it" is worse than a dodge; it shows a fundamental misunderstanding of---or blatant contempt for---our system of laws.

2. Contrary to Scalia's claim, Bush was the plaintiff in this case. Bush brought a state election process into Federal Court, not Gore.
